Our Terms and Conditions

Supply of Goods
  1. Goods supplied in the execution of this Order will be of merchantable quality and to the same general standard as those displayed to the Public in the Company’s various showrooms, but if necessary the Company may change the specification of Goods provided they are of no lesser
  2. (a) Any defect in Goods which comes to the customer’s notice must be reported immediately to the Company
    • Where necessary, the Company, its servants or agents shall be allowed reasonable access to inspect the items forming the basis of the complaint and if necessary reasonable access to remedy the
    • i) On delivery and installation of Goods the customer will be afforded the opportunity of examining

iii) Any alleged breaches relating  to  merchantable  quality,  fi  for purpose or compliance with description shall be reported to the Company immediately.

iii) If it is agreed that there has been a breach the Company will be afforded the opportunity of repairing or replacing Goods the subject of the complaint so as to remedy the breach.

  • Where an Order is accepted by reference to a Plan the Company shall for the purposes of completing an Order only be bound to complete an order in accordance with the description contained in the
Delivery
  1. Date of delivery or date of fi  shall not be construed as a fundamental term of an Delivery dates quoted at the time of placing an Order are subject to availability of furniture and fi
  2. Where delivery or installation on or about the due date is declined by the Customer, full payment being then due, Goods will be held for a further 28 days on a delivery or fi paid basis, as appropriate, after which time storage charges may be applied to the Customer and the Company may apply Condition 4.(b)
Fitting

Where an order includes fitting

  1. This will be carried out in a workmanlike manner. Any failure in this respect accepted by the Company will be rectified by refitting if necessary.
  2. It is the Customer’s responsibility to have the site cleared for installation, have all electrical points repositioned and to arrange for connection and installation of all electrical
  3. It is the Customer’s responsibility to arrange for taking up and refi
  4. The Company cannot be held responsible for damage to electric cable, conduits, pipework or underfloor  heating elements not obviously visible or not set deeply enough in subfloors or sub floors or plasterwork.
  5. The Company cannot accept liability for any additional costs incurred and resulting from alterations instigated by the Customer subsequent to the initial survey, unless notifi in writing to the Company prior to manufacture of the furniture and accepted by the Company in
  6. Where replacements are supplied by the Company in the course of execution of an Order including fi  then the supply of such replacements will include fitting.  Liability is limited as per Condition 2.(c).
  7. All deliveries of Goods and installation must be signed for on a Satisfaction Note on completion of All alleged damage to or faults in Goods and shortages in any items and damage to or faults in work tops must be noted on the Satisfaction Note at the date of fitting.
  8. No liability can be accepted for damage to decorations, or items not supplied by the Company, during the fitting operation, unless reported to and agreed with the installer and clearly noted on the Satisfaction Note at the date of fitting.
Payment
  1. The prices at which Goods are sold are those ruling at the date of an order. These may be varied where delivery periods are extended at the request of the Customer by additional storage charges and application of prices ruling at the time of delivery.
  2. The payment will be collected in 3 parts.
  • Deposit — this is a condition of acceptance of an Order and is a minimum of 25% of the total
  • Instalment of 60% – due on confirmation of the delivery date of the order.
  • Balance of payment – due when the furniture has been delivered and installed to the satisfaction of the customer.
Cancellation:

(a)  If the Customer cancels an Order the Company may at its option forfeit the deposit and/or claim damages for breach of Contract.

(b) If the Customer fails to comply with Conditions as to payment the Company may cancel an Order and at its option forfeit the deposit and/or claim damages for breach of contract.

Force Majeure

In the event of any circumstances, contingency of force majeure occurring beyond the control of the Company preventing, impelling or interfering with the despatch of the whole or any part of the Goods, the Company reserves the right to suspend and/or cancel delivery without incurring liability for any direct or consequential loss, injury or damage which may be caused or sustained by the Customer and/or any third party in consequence of any such suspension and/or cancellation.

Guarantee

Hyperion Furniture’s fitted furniture is made from the finest quality materials and built with infinite care by our own skilled craftsman. To give you extra peace of mind and because we are sure that you will be delighted with our furniture for many years to come, we have included a 10 year guarantee on all our furniture. You are safe in the knowledge that in the unlikely event of any problems, your investment is completely protected. Kindly please read the terms and conditions which apply to this guarantee as specified below. This is by no means a comprehensive list and any specifications not outlined in this guarantee or any other documentation should be confirmed by Hyperion head office in writing.

Wear and Tear, our furniture is not covered for general wear and tear or any misuse /improper use of furniture or any of its components. All care should be taken to prolong furniture life wherever possible. Fold back runner mechanisms should always be in the locked out position before attempting to close the door. Our adjustable shelves are rated for a max load of 60kgs. Due to every design being individual and each customer’s requirement being different, there may be times where the load on a shelf may cause bowing for that given length. All efforts will have been made to minimise this effect, however we cannot cater for all circumstances. We recommended if you experience any bowing over time to periodically reverse the shelves so that it is kept to a minimum.

Drawer Runners and Hinges are guaranteed for life by the Manufacturer but Hyperion Furniture only undertake to repair or replace the defected item free of charge for a period of 10 years. If a hinge or drawer runner become faulty outside of the 10 year guarantee, a call out or labour charge will be applied.

Installation of Hyperion furniture is only guaranteed for as long as it remains installed in the original location. We understand that people want to take their furniture when they relocate, for this reason we can only transfer your guarantee to your new property if Hyperion carries out the work of dismantling, reassembling and fitting. Our furniture is often very heavy so free standing units should only be moved by a minimum of 2 people to avoid any damage. Hyperion cannot take responsibility for any freestanding units moved improperly.

Cleaning and Care products can have a negative effect on the surface of your furniture. Where possible use a clean dry microfibre cloth to remove dust and debris. Should there be any stubborn marks use warm water with a mild detergent. Dry immediately after cleaning.

Variation

No variation of these Conditions shall be effective unless either:-

  1. Made in writing and signed by an authorised employee of the Company, or
  2. Contained in the confirmation issued by the Company upon acceptance by it of an
All goods remain the property of Hyperion Furniture until payment has been received in full.
